Terms and Conditions for Spectrumcura (OPC) Pvt. Ltd. Online Assessment Service (Medicolegal Disclaimer)

1. Acceptance of Terms

By accessing, purchasing, or using the online assessment tools, questionnaires, and reports (the “Services”) provided by Spectrumcura (OPC) Pvt. Ltd. ("Company,” “we,” “our”), the user (“Parent,” “Guardian,” “you”) acknowledges and agrees to be legally bound by these Terms and Conditions. If you are acting on behalf of a minor child (“Child”), you affirm that you are the legal parent or guardian with the authority to consent to these terms for the Child. These terms constitute a legally binding agreement between you and Spectrumcura (OPC) Pvt. Ltd.

2. Nature of Service & No Medical or Diagnostic Advice

You expressly understand and agree that:

  • The Services, including any assessment, report, or output generated, are screener tools and informational resources only. They are designed to provide insights and are based on patterns, algorithms, and generalized professional knowledge.
  • The Services are not a substitute for, and do not constitute, professional medical advice, diagnosis, treatment, or intervention from a qualified healthcare provider, including but not limited to a pediatrician, developmental pediatrician, child psychiatrist, clinical psychologist, or boardcertified behavior analyst (BCBA).
  • No doctor-patient, therapist-patient, or any other professional client relationship is formed by your use of the Services.
  • Spectrumcura (OPC) Pvt. Ltd. does not provide medical, diagnostic, or therapeutic services through these online assessments.

3. Parent/Guardian Responsibility & Assumption of Risk

You accept full and sole responsibility for all decisions and actions taken regarding your Child’s health, development, and care following the use of our Services. You specifically agree to:

  • Seek Independent Professional Evaluation: You must consult with appropriate, licensed healthcare professionals for a formal evaluation, diagnosis, and any treatment plan for your Child. You agree not to use the Service’s outputs as a standalone diagnostic tool.
  • Provide Accurate Information: You warrant that all information you provide during the assessment is accurate and complete to the best of your knowledge. Spectrumcura (OPC) Pvt. Ltd. is not liable for outcomes based on inaccurate or incomplete information.
  • Interpretation and Use of Reports: You acknowledge that any report generated requires careful interpretation, which should be done in consultation with a qualified professional. You assume all risk associated with the interpretation and application of the information provided.
  • Emergency Situations: The Services are not for use in emergencies. If your Child is in crisis or poses a danger to themselves or others, you agree to contact emergency services immediately

4. Limitation of Liability & Disclaimer of Warranties

  • No Warranties: The Services are provided on an “as is” and “as available” basis. Spectrumcura (OPC) Pvt. Ltd. expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
  • Limitation of Damages: Spectrumcura (OPC) Pvt. Ltd., its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for emotional distress, loss of profits, loss of data, costs of procuring substitute services, or any damages arising from:
    • Your reliance on the Services in place of professional medical advice.
    • Any delay or failure in seeking professional care based on the Service’s outputs.
    • Any decisions or actions taken by you or a third party based on information from the Services.
    • The interpretation, use, or misuse of any report or data.
  • Total liability cap:In no event shal Spectrumcura (OPC) Pvt. Ltd.’s total aggregate liability to you for all claims arising from these Terms or your use of the Services exceed the amount you paid to the Company for the specific assessment in question.

5. Indemnification

You agree to defend, indemnify, and hold harmless Spectrumcura (OPC) Pvt. Ltd., its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services.
  • Your violation of any term of these Terms and Conditions.
  • Your violation of any third-party right, including without limitation any copyright, property, privacy, or medicolegal right.
  • Any action you take or fail to take regarding your Child’s care based on the Services, including any failure to seek appropriate professional diagnosis or treatment.

6. Governing Law and Exclusive Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
  • Any legal suit, action, proceeding, or dispute arising out of, or related to, these Terms or the Services shall be instituted exclusively in the competent courts located in Lucknow, Uttar Pradesh, India. You irrevocably submit to the personal and exclusive jurisdiction of such courts and waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts, including on grounds of forum non conveniens
  • You agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

7. Acknowledgment of Understanding

By proceeding with the assessment, you acknowledge that

  • You have read, understood, and agree to these Terms and Conditions in their entirety.
  • You understand the non-diagnostic, informational nature of the Service.
  • You accept the critical requirement to seek independent professional evaluation for your Child.
  • You are waiving certain legal rights, including the right to sue in any jurisdiction other than Lucknow, India, as outlined in these Terms.

8. Modifications

Spectrumcura (OPC) Pvt. Ltd. reserves the right to modify these Terms and Conditions at any time. Your continued use of the Services after any such modification constitutes your acceptance of the new Terms

By checking the box below or clicking “I Agree,” you provide your electronic signature, which constitutes your legal acceptance of these Terms and Conditions with the same force and effect as a handwritten signature

I HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. I EXPLICITLY ACKNOWLEDGE THAT ANY LEGAL PROCEEDING SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS IN LUCKNOW, INDIA, AND I WAIVE ANY RIGHT TO CHALLENGE THIS JURISDICTION.
